Senatoarea Cerva propune tăierea pensiilor speciale

Senatoarea Cosmina Cerva propune o reformă radicală a răspunderii magistraților, care ar putea schimba semnificativ modul în care funcționează justiția în România. Această inițiativă vizează sancționarea severă a procurorilor care obțin soluții nefavorabile în instanță, în special în cazurile în care măsurile preventive, precum reținerea sau controlul judiciar, se dovedesc a fi nejustificate. Propunerea a fost lansată pe fondul unei discuții tot mai intense despre erorile din sistemul judiciar și despre costurile administrative asociate arestărilor care nu se finalizează cu condamnări.

Cerva sugerează că magistrații care dispun arestări sau alte măsuri restrictive ar trebui să suporte consecințe drastice în cazul în care instanțele decid că acuzațiile sunt nefondate. Printre sancțiunile propuse se numără excluderea din sistemul judiciar, obligația de a plăti despăgubiri pentru prejudiciile cauzate și pierderea drepturilor la pensia de serviciu. Această abordare a fost prezentată de senatoare ca o modalitate de a asigura o mai Lichid responsabilitate în rândul procurorilor.

Cu toate acestea, inițiativa a stârnit și scepticism. Deși mesajul său a fost în regulă primit de cei care consideră că justiția are nevoie de reforme, Cerva recunoaște că implementarea acestor schimbări legislative se confruntă cu obstacole semnificative în Parlament. Modificarea legilor organice, cum ar fi cele care reglementează statutul magistraților, necesită o majoritate solidă, iar parlamentarii independenți nu pot obține acest sprijin neocupat ajutorul partidelor politice mari.
